O direito em contos folclóricos: princípios legais incorporados em narrativas orais indígenas e franco-canadenses

Resumo

Este artigo é uma contribuição à descoberta de conceitos e princípios do direito inseridos em narrativas orais de origem indígena e franco-canadense, o que é feito com o objetivo de aprofundar o diálogo entre as diferentes tradições jurídicas. O texto é dividido em duas partes. A primeira direciona o enfoque ao estudo literário do folclore indígena e franco-canadense. Argumenta-se que narrativas orais folclóricas constituem um legítimo e relevante objeto de pesquisa para a área do direito e literatura, pois elas apresentam-se como fontes densas e potentes de noções, conceitos e princípios jurídicos. A segunda parte analisa diretamente um arquétipo de contos populares indígenas e franco-canadenses. O objetivo é encontrar noções, conceitos e princípios jurídicos nas personagens sobrenaturais do wendigo e do lobisomem.
