"Pathur Nataraja": a personificação jurídica de uma deidade

Pathur Nataraja é uma estatueta medieval indiana de bronze que foi contrabandeada para fora de seu país de origem. Apreendida no exterior, a obra de arte foi disputada na justiça britânica em julgamento que identificou a personalidade jurídica da divindade hindu Shiva no lingam que havia sido preservado no templo saqueado. Seu reconhecimento, aliado à ideia da personificação jurídica de inúmeras outras entidades não humanas, como a natureza, um parque nacional, um rio com seus elementos metafísicos, as árvores, os animais não humanos, a inteligência artificial e robôs, vem criando fissuras na tradicional compreensão sobre o que significa ser sujeito de direitos. Esta compreensão fluída da personificação legal, presente em diversas conjunturas jurídicas atuais e já intuída por uma doutrina secular, é indicativa de opções epistêmicas capazes de serem igualmente absorvidas em nosso universo jurídico.
