A ARTE É UM DIREITO FUNDAMENTAL? UMA ANÁLISE DO CONTRASTE ENTRE A SEMANA DE ARTE MODERNA E A COOPERIFA

Abstract

The present work is inserted in the studies of Law and Literature in order to analyze the contrasts of the Week of Modern Art of 1922 and the Week of Modern Art of the Periphery designed by Sergio Vaz in order to make it possible to bring the reflection that the arts, as well as literature, must be observed as a fundamental right as lectured by Antonio Candido. From this intention, it uses the methodological strategy of bibliographic survey, based on the comparative and historical method, and the studies of hermeneutics and legal philosophy to make a critical analysis.in order to demonstrate that art is part of the construction of memory, culture and, therefore, the identity of the people, deserving legitimate observance within the list of fundamental rights of the Federal Constitution of 1988.
