The paper aims at presenting the reading of Kafka developed by the Australian Philosopher Peter Fitzpatrick, bringing it to the context of his critical reflection concerning the mythical foundations of modern Law. Presenting briefly the main issues of Fitzpatrick’s thought, the paper seeks to show the potentiality of novels and short stories written by Kafka to the deconstruction of some of the paradigms which move the modern conception of Law. Moreover, the article analyzes to what extent the deconstruction of the mythical contents of Law has an emancipatory role, thus bringing to the surface elements of racism, imperialism, colonialism and violence which are hidden below the traditional discourse of a rational law.Downloads
