Mucho más allá de artículos: los debates sobre derecho y literatura en los textos de "Cardozo Studies in Law and Literature" (1989-1995)

El presente artículo tiene como objetivo mapear los debates presentes en las ediciones del periódico Cardozo Studies in Law and Literature entre 1989 y 1995, más allá de los artículos científicos publicados, centrándose en textos de géneros variados, como prefacios, introducciones, reseñas y otros. La metodología adoptada implicó la lectura completa de las ediciones de este período, en las cuales se identificaron 132 textos, de los cuales 44 no eran artículos académicos. Los resultados revelan que los textos destacaron la importancia de la interdisciplinariedad entre el derecho y la literatura; la relevancia de la retórica y de la libertad de expresión; y las intersecciones entre narrativas literarias y cuestiones jurídicas. También surgieron algunas divergencias sobre la intersección entre el derecho y la literatura, enfatizándose en ocasiones el carácter teórico-filosófico de la empresa, y en otras su uso práctico por los operadores del derecho. La conclusión del estudio evidencia que el análisis de estas publicaciones es tan importante para comprender la génesis y el desarrollo del debate como la lectura de los artículos científicos dedicados al tema.
