The right to privacy between the legal doctrine and the literary fiction: what "1984" can tell us about technology and politics?

The immediate object of this study is the right to privacy. This theme is examined from an interdisciplinary perspective between Law and Literature, bringing together legal and fictional aspects and discussing current trends and challenges. Initially, the formation of the theme in the United States is investigated, followed by an exploration of how the topic is treated in the Brazilian Constitutional Text of October 5, 1988. After the first section, related aspects present in George Orwell’s dystopia, 1984, are covered, and ideas and narratives in the work are explained. A number of questions are then analyzed. Finally, based on the aforementioned elements, certain trends on the right to privacy in the legal field are brought to light. Parallels are established with concrete issues: China's Social Credit System and the Brazilian Law n. 13,709, of August 14, 2018.
